Alberta couple looking to appeal ruling on third trial in death of son

LETHBRIDGE, Alta. – An Alberta toddler’s parents who have faced two trials in his death say they want to take an Appeal Court order for a third trial to the Supreme Court of Canada.

David and Collet Stephan’s case was back in a Lethbridge courtroom today.

The two testified at their earlier trials that they thought their son had croup and were treating him with natural remedies before he died.

They were accused of not seeking medical attention sooner for 19-month-old Ezekiel, who died in 2012.

A jury convicted them in 2016, but the Supreme Court of Canada overturned that verdict and ordered a second trial.

A judge hearing that case found them not guilty in 2019, but the Alberta Court of Appeal overturned the acquittal last month.

Lawyers for the Stephans say they are filing an application for leave to the Supreme Court.

They say they are also asking the Alberta Court of Appeal to stay proceedings while the request to the country’s highest court proceeds.
