Man convicted in Peace River jail beating files appeal
Alberta Court of Queen’s Bench says a Grovedale man has filed a notice of appeal of an aggravated assault conviction.
Herbert Charles Wanihadie was convicted on June 13 and given a six-and-a-half year sentence on June 25. He was one of three people given jail time in connection with an attack on another man at the Peace River Correctional Centre. The man was left in a coma.
Court of Queen’s Bench says in an email that Wanihadie’s side is basing its appeal on what it considers errors by the trial judge.
They assert that the judge made a mistake by relying on what they term “non-expert opinion evidence from correctional officers”, along with, quote, “misunderstanding the issue in a mistrial application and failing to find an air of reality to his claim of self defence.”
