Alberta Court of King’s Bench orders PRSD to reinstate disqualified Board Member

The Alberta Court of King’s Bench has overturned Peace River School Division’s Board of Trustees’ decision to disqualify a former member.

Justice Funk is ordering that Moise Dion be reinstated on the board after he was disqualified in September of last year.

The disqualification came about after Dion failed to comply with remedial actions following a violation of the Trustee Code of Conduct and inappropriate comments directed at an employee.

Justice Funk concluded that the board failed to make any findings regarding what comment Dion made precisely and that the sanction imposed was unjust and excessive.

Dion will resume his role on the board until the end of the term of office for which he was elected, and the board will repay any honorarium, salary or entitlement not paid during the period of disqualification.
