An Alberta couple facing a retrial in the meningitis death of their son has lost their bid for four-million dollars to pay for past and future legal bills.
Justice John Rooke in Calgary rejected the request by David and Collet Stephan and also turned down their request for a stay of the proceedings.
The Supreme Court of Canada overturned their convictions of failing to provide the necessaries of life to their 19-month-old son Ezekiel on grounds the trial judge did not properly instruct jurors.
A new trial is to begin in June. (The Canadian Press)
